Confirmation of by-election: 20 AAP MLAs declared inept for holding office of profit
Election Commission of India (ECI)
has given Aam Admi Party (AAP) a sudden jolt by disqualifying its 20 MLAs for holding
office of profit. The action has been taken by the President of India on the
recommendation of ECI. As it has been known to every member of the Aam Aadmi Party about the term “Office of Profit”, despite that they had served as the parliamentary
secretaries from 15th March 2015 till September 8, 2016. The reason behind holding the post is to get
the benefits, perquisites & the salaries that a holder of the position has
to get as per rules of the Government.
There’s a rule in the
constitution that has been mentioned in the Articles 102(1) (a) & 191(1) (a),
that an MP or an MLA can be debarred, if they are holding an office of profit
in Central or State Government.

This becomes the reason that the
President of India has disqualified the 20 MLAs of AAP on the recommendation of
Election Commission of India.
In this case, EC had sent the
recommendation for disqualifying 21 MLAs of Aam Admi Party, but unfortunately
one member has resigned from the post few months ago which led to the process of
disqualification of 20 MLAs who are found as inept.
In spite of debarring 20 MLAs,
the ruling party AAP has the majority in the Delhi Assembly with 45 members from
the 70 member assembly seats. Though AAP will lose its 20 members, it won’t
jeopardize the Arvind Kejriwal led Gov. in Delhi.
This action of ECI raised the
anger among the AAP members which coerced them to tweet on this issue which is becoming
a matter of talk among the opposition.

There has been anticipation
that the disqualification of AAP MLAs will bring a situation of by-election in
the party. But it won’t happen as still they are in the majority in the
assembly with 45 seats which is enough for them to remain in the power as the
ruling party of Delhi Government.
